Sam Burgess has asked a court to take action against his wife Phoebe for drug and domestic violence allegations made against the former NRL star

M Burgess did not appear in local court in Moss Vale on Monday, as his lawyer Bryan Wrench fought back on several fronts against damaging allegations against the former skipper of South Sydney

M Wrench previously told the court that he intends to file a notice of motion to have M’s wife and stepfather. The case will now go to a hearing in November and Ms Burgess’ lawyers are expected to oppose the summons

M’s lawyers Burgess seek to subpoena the information with a view to requesting that Ms Burgess and Mr Hooke held in contempt of court

M Wrench attempted to file a request on Wednesday for the contempt of court case to go to a hearing, but was quickly reprimanded by magistrate magistrate Ian Cheetham

M Cheetham stated that M Wrench missed the seven-day deadline for filing the notice of motion and failed to file an affidavit as required

« There is no affidavit There is some form of timeline and no evidence to support the claim, » said M Cheetham

M Burgess is also fighting allegations that he intimidated Mr. Hooke at his Southern Highlands estate in October last year

Wednesday, M Wrench has also officially pleaded not guilty to an additional charge of common assault

Police attorney Jamie Palmer also told court on Wednesday that Ms Burgess’ affidavit had nothing to do with the bullying case and would not be used as evidence

The charges of intimidation against M Burgess are also set to be heard on November 16
