Former Home and Away star Joel McIlroy has asked for police assault charges to be dealt with on mental health grounds, after a court was informed he was diagnosed with a degenerative brain disease, Huntington’s disease

McIlroy, 47, allegedly held a police officer in a headache and punched her in the head after intervening in someone else’s arrest in Surry Hills on October 22, 2018. ‘last year

Police arrested a man for minor property offenses around 11:15 a.m., when McIlroy allegedly approached and charged the senior constable’s shoulder.Two officers then attempted to arrest him, it is alleged, but a fight ensued and all three fell to the ground

On Tuesday, a prosecutor told the local Downing Center court that McIlroy shouted « film this, this is police brutality » during the crash and claimed he was strangled

McIlroy was arrested and charged with two counts of assaulting an officer in the line of duty, one count of assaulting an officer causing bodily harm, resisting an officer in the ‘performance of duty and willful obstruction of an officer

He spent 103 days in custody before being released on bail in Supreme Court in February

McIlroy’s attorney Elliot Rowe on Tuesday requested that the charges be dealt with under Section 32 of the Mental Health Act, which would mean they are fired and the court would instead order Health care

M Rowe said her client was diagnosed with Huntington’s disease in 2007, a « very rare degenerative disease » that makes it difficult to regulate emotions and solve problems

« The medical equipment clearly shows that not only does he suffer from this cognitive impairment, but that it is quite a serious and debilitating problem for him, » said M Rowe

He said McIlroy appeared to have « a misunderstanding » of the police situation he intervened in

Magistrate Jennifer Giles said the alleged behavior was « exactly what we are trying to protect the community from »

« How safe is the community as he walks around? » She asked « He buys things that don’t concern him and then gets violent »

M Rowe said the magistrate might find the situation a « red flag » for McIlroy and offered « a very structured and detailed level of supervision » by medical professionals

Police District Attorney Master Sergeant Amin Assaad said McIlroy « got his nose stuck where it didn’t belong » and then engaged in the « serious » conduct of punching a woman’s head

He said McIlroy shouted « police brutality » during the incident, which shows he knew full well who was in control of him

« At one point your honor, Mr. McIlroy will have to be held accountable for his actions, « said Master Sergeant Assaad « Members of the community should be protected from his conduct »
